BROKER PARTICIPATION COMMISSION is VARIABLE

With a duly registered buyer and/or agent of a qualified Real Estate Broker, the Buyers Broker may be paid $500 BONUS more or less or at Listing Broker/Auctioneers option up to a 2.5% fee based on the initial offer with the buyer broker qualified registration subject to procuring cause rights. Any commission payment shall be subject to the full collection of the Buyer Premium paid by the buyer as described in the Specific Terms and Conditions of Sale. Buyers (at the Brokers/Auctioneers option) could receive a variable concession from zero to five percent on a written opening bid (on a bid sheet provided by the auctioneer) being conditionally subject other incentive payments paid to the buyer and may be paid only if the Buyer’s Agent is the actual procuring cause and have properly submitted the correct forms, holds an exclusive buyers representation agreement and has advised the buyers of the terms and condition of sale, abiding by all announcements, procedures, or other direction without claiming any exceptions to any foregoing procedure and having all parties Buyers Broker/Agent and Buyers having completed the online registration form at MyersJackson.bid, Acre. Bid, LetsGo.Auction or other site directed by the Listing Broker/Auctioneer. All offers/bids must be made through the Auctioneer by order of the seller. Other written incentives may apply but not guaranteed. The Buyer or Buyer’s Agent must retain possession of a written agreement for any payment given by Listing Broker/Auctioneer.

Buyers’ Broker payments shall not apply in the case that the buyer is given any portion of a discount or any concession, or modification from the buyer premium, auction premium or auctioneers fee, other incentives or other discounts to reduce the required buyer payments. Payments to Buyers Brokers and their Agents shall not apply if a buyer broker/agent agreement exists for compensation between the buyer and the buyer agent’s broker. In the event the Buyer receives any discount or other incentives, and the Buyers Broker holds or does not hold an exclusive buyer representation agreement the Listing Broker shall not pay any Buyer Broker Compensation unless an agreement between the parties have been made in writing prior to the execution of the Memorandum of sale. Any payment arrangement or agreement must be written in advance.

Additionally, the Buyer’s Agent shall only be paid a commission or other payments (if any) after proper offline and online registration of any represented or non-represented buyer with both the Buyer’s and the Buyer’s Broker/Agents’ full and correct information and then by completing the authorized form in writing or by completing full registration in an authorized bidding system.

The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. No statement, whether written or oral, and whether made in the listing, or in supplements to the listing, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, brokers, agents or otherwise, shall be deemed to create any warranty, representation or assumption of liability.
